What is Florida's no fault death benefit?

Under the Florida no fault death benefit law, if a person is killed after being struck by a vehicle, either as a driver or passenger of a motor vehicle, or as a bicyclist or pedestrian, his or her family may be entitled to no fault death benefits up to $5,000.

If you have recently lost a family member in an auto accident, a South Florida wrongful death lawyer may be able to help you recover your Florida no fault death benefits or file a wrongful death claim in Florida against the responsible party.

If the deceased had his or her own vehicle insurance that included no fault coverage (a requirement in Florida), the death benefit should be paid out of his or her policy.

If the deceased did not have vehicle insurance that included no fault coverage, the Florida no fault death benefit should be paid by the no fault policy on the vehicle that caused the Florida accident. That is, the responsible driver's insurance company will pay the Florida no fault death benefit.

For the deceased's family to claim the Florida no fault death benefit, they will have to provide the insurance company with a copy of the death certificate and police report stating that the death was caused by a motor vehicle accident. The family may also be eligible to file a wrongful death claim in Florida to recover additional damages.
